1. Agreement to Terms

By accessing or using ModelPilot ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ModelPilot is an AI model routing platform that:

• Routes API requests to various AI model providers (OpenAI, Anthropic, Google, OpenRouter, etc.)
• Optimizes for cost, speed, quality, and environmental impact
• Provides analytics and usage tracking
• Charges a routing fee per million tokens processed

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use this Service
• You may not share your account with others

3.2 API Keys

• You are responsible for securing your ModelPilot API keys
• API keys should be treated as passwords and not exposed in client-side code
• Lost or compromised API keys should be regenerated immediately through your dashboard

4. Pricing and Payment

4.1 Pricing Structure

• Provider Costs: You pay AI model providers at their standard rates
• Routing Fee: ModelPilot charges a routing fee based on token usage:
  • Starter: $0.50 per million tokens routed (first 100M tokens/month)
  • Pro: $0.25 per million tokens routed (first 400M tokens/month)
  • Enterprise: $0.10 per million tokens routed (400M+ tokens/month)
• All pricing is subject to change with 30 days notice

4.2 Billing

• Pre-paid credits system: You purchase credits in advance
• Credits are deducted as you use the service
• Minimum credit purchase: $10
• Auto-refill available with threshold settings
• All payments processed securely through Stripe

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service
• Use the Service to generate harmful, abusive, or illegal content
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without permission
• Exceed rate limits or abuse the API
• Use the Service to compete with ModelPilot

6. Content and Data

6.1 Your Content

• You retain all rights to content you submit through the Service
• You grant ModelPilot a license to process your API requests to provide the Service
• You are responsible for ensuring you have rights to any content you process

6.2 Our Use of Your Data

• API Request Data: We log metadata (model used, tokens, latency, cost) for analytics and billing
• API Request Content: Request/response content is NOT stored beyond temporary caching
• Training Data: We do NOT use your API requests or responses to train AI models
• Analytics: Aggregated, anonymized usage statistics may be used for service improvement

6.3 Provider Data Policies

• Your requests are forwarded to third-party AI providers (OpenAI, Anthropic, etc.)
• Each provider has their own data policies and terms
• You are responsible for reviewing and complying with provider terms
• ModelPilot is not responsible for how providers handle your data

7. Refund Policy

7.1 Credit Purchases

• Credits are generally non-refundable once purchased
• Refunds may be issued at our discretion for:
  • Service outages exceeding 24 hours
  • Billing errors
  • Unused credits within 7 days of first purchase (one-time exception)

7.2 Requesting Refunds

Refund requests must be submitted to help@modelpilot.co and will be reviewed within 5-7 business days.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ModelPilot is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 3 months
• We are not responsible for third-party provider outages or errors

9. Data Protection (GDPR)

9.1 Your Rights

• Right to access your data
• Right to correction of inaccurate data
• Right to deletion (subject to legal retention requirements)
• Right to data portability
• Right to object to processing
• Right to withdraw consent

9.2 Data Retention

• Account data: Retained while account is active + 90 days after deletion
• Usage analytics: Retained for 14 days (detailed), 2 years (aggregated)
• Billing records: Retained for 7 years (tax/legal requirements)

10. Changes to Terms

• We may update these Terms at any time
• Material changes will be notified via email or dashboard notice
• Continued use after changes constitutes acceptance
